This website privacy policy explains how Benjel Chimistes Conseil inc collects, uses, keeps secure and discloses personal information and the choices you have regarding the information that Benjel Chimistes Conseil inc collects, uses and discloses during your experience in online via our website benjel.ca and its subdomains (collectively the “Sites”). Our privacy practices are based on and consistent with the Act respecting the protection of personal information in the private sector of Quebec, the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada and the ten internationally recognized privacy principles.
In this policy, when we say “we”, “us” and “our”, we are referring to Benjel Chimistes Conseil inc. (hereinafter referred to as “Benjel”). When we say "member", we are referring to a person who has purchased a membership share and obtained a membership. When we say "you", "user" or "individual(s)", we refer to the person accessing our sites and applications.
In this policy, “Personal Information” means information about an identifiable individual such as name, email address, residential address, and telephone number. Personal Information also includes more sensitive information such as gender, age, health status, family information and any other data attributed to an individual.

Limited collection and use of personal information
Benjel Chemistes Conseil inc. collects, uses and discloses personal information for the following purposes:

- To verify the identity of a member;
- To determine the eligibility of our members for shareholding;
- Allow Benjel Chemistes Conseil inc. to offer high quality service to our individuals;

- To contact individuals directly for products, content and services that may be of interest to you;
- To enable individuals to use our technologies in-store and online;
- To meet regulatory requirements; And
- To provide regionally relevant user content.
We will only collect the minimum information necessary to achieve these purposes; However, we also offer you the voluntary opportunity to share additional information (e.g. your geographic location, product reviews, etc.) to improve your and others' experience with our Sites and Apps.

All people (members and non-members)
Email address:
When you register for a user account, we collect your email address. Your email will be used for account generation, and it will also be used to contact you for product information, service updates, and notifications relating to the Sites and the App. In accordance with Canadian anti-spam legislation (SC 2010, c. 23) (CASL) with your consent, your email address will also be used to provide you with information for promotional and marketing purposes. At any time, you can opt out of most email communications from us by clicking the unsubscribe link at the bottom of our emails, updating your subscription preferences in your online user account or by contacting ourservice center. Live chat feature:
When you start a “live chat” with Benjel staff, our third-party platform will collect your name and you will also have the option to submit your email address. You will be bound by our Website Privacy Policy and Platform Terms of Use, which are provided for your review when you access the live chat system. Benjel will use the information you provide during live chat to respond to your requests and questions submitted through the live chat system and to improve your experience while using our sites.
Website Feedback Form:
When you submit feedback on our Sites through our “Website Feedback Form” and/or respond to an online survey that we have circulated, our third-party platform collects information about you, including your opinions and comments expressed on your Benjel experience. You will also have the option to submit your email address. You will be bound by this Website Privacy Policy and the Platform Terms of Use, which are provided for your review when you access the Website Feedback Form and/or Survey. Benjel will use the information you provide to improve the user experience and respond to comments. We may contact you to request further information regarding the feedback provided.
Product Ratings & Reviews / Question & Answer Options:
When you submit a product review through the “Rating & Reviews” option on our sites and apps or “Ask & Answer” on the product, our third-party platform will collect your email address, a nickname (which will be displayed publicly when your review or question is posted), and information about your experience with the product and/or questions about the product. Any information or photos you provide other than your email address will be publicly posted on our sites and apps and by submitting you agree to the platform's terms of use. We will use this information to answer your questions, follow up on any product concerns or issues, and make improvements to your overall experience with Benjel. However, we reserve the right to exercise our discretion in responding to all reviews and questions. If you have purchased a product from Benjel, you may also be contacted by us with the opportunity to provide a response to questions posted in the “Feedback” section, and your engagement in these opportunities is entirely voluntary. Please note that email collection in the “Rating & Review” and “Request & Reply” options is not used for marketing purposes.
Aggregated Site Usage Information:
We record information about the pages viewed by everyone who accesses our sites and our application. This data includes Internet Protocol (IP) address, browser type, Internet Service Provider (ISP), referring/exit pages, platform type, date/time stamp, speed connection time, reading time, display time and number of clicks. We use this data, in aggregate form, to compile statistics and reports for Benjel's use, and to improve the online experience for all visitors. We may, from time to time, provide portions of this aggregated information to suppliers, consultants, potential advertisers or news agencies. Your physical location:
To provide you with location-based services, we may collect, use and share the physical location of your device using, for example, satellite, cell tower or Wi-Fi signals. Some location-based services offered by Benjel, such as the “Store Locator” feature and location-based push notifications, require your personal information for the feature to work. Mobile device:
If you use a mobile device to access the Sites, we may collect device information (such as your mobile device ID, model and manufacturer), operating system and version information, IP address and geolocation information.

Cached data:
When you use our sites and applications, certain data is cached in your device's memory. Cached data is encrypted and retained on the device as long as you are logged in, even if the sites or app are in the background. Data is deleted from the device when you log out of the sites and app and does not remain on the device.
Additional member-specific information
Processing member purchases on our sites and applications:
When Members purchase an item from our Sites, we only request the information necessary to complete order processing and billing, which includes your shipping and billing address, phone number, credit card information and of debt.
Your payment will be processed by an authorized third-party platform and shipping information will be shared with the shipping companies that fulfill the shipment of your order on behalf of Benjel. As noted above, to speed up your purchases, in your user account you can choose to save your preferred shipping and billing address, as well as your payment card details.
Disclosure of information
Disclosure of information by Benjel:
Benjel will not disclose personal information for purposes other than those identified in this privacy policy. We do not sell, rent or disclose your personal information to any third party without your consent, unless disclosure without your consent is required or permitted by law.
For example, in certain circumstances, Benjel will disclose your personal information without first obtaining your consent to:
- Legal Authorities: When we are required or permitted by law to cooperate with local, national or international law enforcement or other authorities in reporting and/or investigating inappropriate or illegal activities, at the request of a third party or if we believe disclosure is reasonable to comply with court orders, protect the health and safety of persons, or protect the rights and property of Benjel.
- Trusted Third Party: When the services we provide to you require us to provide your information to a third party who performs functions on our behalf. Your information will be treated with the same level of confidentiality and security that we are committed to providing as an organization and will not be used for any purpose other than those authorized by us.
Disclosure of information by you:
By You: You may disclose information when you post content on our websites, in-store technologies, or other public forums, such as our brands' social media pages, blogs, and online product reviews. Any information you disclose through these services will become public.
Social Sharing: When you use certain aspects of the Benjel Website or other services, or post information on other social networking sites (for example, by posting a link to Benjel's Facebook or Twitter pages, or by “liking” a product on your Facebook or Instagram account, or “pinning” a product on your Pinterest account), personal information that you post or share in connection with these third-party sites is visible to other people and may be read, collected, used and disclosed by other people. Any information provided to these third party social networking sites and other sites is beyond the control of Benjel and is not governed by this Privacy Policy.
Debt recovery: where it is necessary to establish or recover amounts owed to us.
Retention of information
At any time and without penalty, you can close your Benjel online account by sending an email to Member Services at info@benjel.com. If you want to update or delete specific information that you have saved in your account, you can update it yourself by logging into your account (e.g. credit cards on file, billing address, etc.) .
If you would like your information to be deleted from our databases, or if you no longer want us to send you further communications, you can adjust your email settings through your online account or you can send an email to member services at info@benjel.com. Where your information is stored with our third parties, we will proceed if necessary to delete your information as requested. If you decide that you no longer want us to send you further communications, we may still contact you for product security reasons. For members who joined in the previous financial year, in accordance with our legal obligations.
Where you have purchased products through Benjel, we will retain a copy of your purchase history to ensure proper enforcement of our warranty unless otherwise requested. However, if you request that we delete your purchase history, this may negatively impact our ability to honor this warranty. As noted above in Additional Member-Specific Information, as a cooperative we are required by law to maintain certain information about our members. We are required by law to retain this information even after a member has terminated their membership.
Consent
Benjel takes a consent-based approach to the collection, use and disclosure of personal information. Subject to situations where consent is not required by law, we identify the purposes for which we collect your personal information no later than the time we collect it. Depending on the nature and sensitivity of the personal information we collect, we will do one of the following: (1) obtain your express consent to the collection; (2) implies your consent to the collection because you have chosen to provide us with your personal information; or (3) deem you to have consented to the collection, unless you have chosen to decline to provide consent where we have made an opt-out option available.
Precision
Benjel relies on you to ensure that the personal information you provide to us when using the Sites and the Application is as accurate, complete and up-to-date as necessary for the purposes for which it is to be used. You can make changes, request deletion or correction of personal information at any time. For Benjel members, membership information previously provided to Benjel by calling Member Services at 1-800-312-9581.
Guarantees
Benjel uses administrative, technical and physical safeguards to protect your personal information against loss, theft and unauthorized access, use, disclosure, copying, modification, disposal or destruction in accordance with requirements applicable legal and industry standards. For example, we implement encryption and security controls to protect against unauthorized access to personal information during electronic transmission and require third parties acting on our behalf to maintain reasonable and appropriate safeguards.
We will review and update our security policies and controls as technology evolves to ensure the continued security of your information, however, please keep in mind that no transmission over the Internet or email is never completely secure or error-free and that no security system is impenetrable. We cannot fully guarantee the confidentiality of the information you share with us.
Opening
Benjel makes clear and transparent notice of our privacy practices available to the public through this Privacy Policy and through the notices we provide to you at the time we collect your personal information directly from you.
Individual access
At any time, you can review, edit or request deletion of the information you have provided to Benjel in accordance with the requirements described in the Retention of Information section above. Upon written request to the Benjel Privacy Office, Benjel will also provide you with a list of entities to which we have disclosed your personal information.
Additional features and information
It is important to protect your privacy when you are online. If our Sites and Apps contain links to other websites, those websites are not governed by this Privacy Policy. Whether we or other organizations have posted these links, or whether individuals have posted these links, you should read their privacy policies and make an informed decision about whether to use those websites or their services.
Where Benjel has allowed you to connect to other third-party platforms in order to use their services in conjunction with our sites and applications, you will be subject to their collection practices and the terms of use and privacy policies of these third-party platforms . You are responsible for reviewing and accepting these privacy policies and these terms and conditions. If you do not agree to the terms of use or privacy policies of third parties, you should not use the services offered by these third party service providers. Except when collected by Benjel for the purpose of purchasing a subscription or becoming a member, Benjel does not knowingly or intentionally collect personal information from users under the age of majority.
Changes to this privacy policy
We may update this policy to reflect changes to our information practices, but we will not reduce your rights under this privacy policy without your explicit consent. We will post all changes on this page and, if the changes are significant, we will provide a more prominent notice such as an email notification.
